We use this information, if collected, only in aggregate form for basic security and site-operation purposes.

No mobile or messaging consent information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

5. Data Retention

We retain the personal information you submit through the Contact Us form for as long as reasonably necessary to fulfill the purpose for which it was collected — generally, to respond to your inquiry and maintain a record of our business communications — and thereafter for as long as needed to comply with our legal obligations, resolve disputes, and enforce our agreements. Waymaker currently retains contact form submissions for 12 months for inquiries that don't result in an engagement; consistent with our standard business records retention thereafter if a client relationship begins.

We have implemented reasonable administrative, technical, and physical measures designed to protect the personal information you provide to us from accidental loss and from unauthorized access, use, alteration, or disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), gives you certain rights regarding your personal information. This section describes those rights and how to exercise them.

7.1 Categories of Personal Information Collected

In the preceding 12 months, we have collected the following categories of personal information, as defined by the CCPA, through the Contact Us form: identifiers (such as name, email address, and phone number), and, if voluntarily included in your message, other information you choose to share. We collect this information directly from you. We do not collect sensitive personal information, and we do not collect any of the other CCPA-defined categories (such as biometric information, geolocation, or internet activity beyond basic web server logs) through the Contact Us form.

7.2 Use and Disclosure of Personal Information

We use and disclose the personal information described above for the business purposes described in Sections 3 and 4 of this policy. We do not sell or share (as "share" is defined under the CCPA, including for cross-context behavioral advertising) your personal information, and we have not done so in the preceding 12 months.

7.3 Your Rights

Subject to certain exceptions and limitations, California residents have the right to:

  • Right to Know/Access — request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purpose for collecting it, and the categories of third parties with whom we share it
  • Right to Delete — request that we delete personal information we have collected from you, subject to certain exceptions
  • Right to Correct — request that we correct inaccurate personal information we maintain about you
  • Right to Opt-Out of Sale/Sharing — because we do not sell or share personal information, there is currently nothing to opt out of; we will update this policy if that changes
  • Right to Limit Use of Sensitive Personal Information — not applicable, as we do not collect sensitive personal information
  • Right to Non-Discrimination — we will not discriminate against you for exercising any of these rights

To protect your information, we will need to verify your identity before processing your request, typically by matching the information you provide in your request (such as your name and email address) against the information in our records. If you designate an authorized agent to submit a request on your behalf, we may require proof of the agent's authorization and may still require you to verify your own identity directly with us.

We will respond to a verifiable consumer request within 45 days of receipt. If needed, we may extend this period by an additional 45 days, in which case we will notify you of the extension and the reason for it.

8. Other State Privacy Rights

Residents of certain other U.S. states (such as Virginia, Colorado, Connecticut, Utah, and others that have enacted comprehensive privacy laws) may have similar rights to know, access, delete, and correct their personal information, and to opt out of certain processing. The Website is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13.
